Air fresheners' customization service

These general terms and conditions of sale govern the agreement between:

Société de Diffusion d’Accessoires Automobiles, hereinafter referred to as SDAA,a company with a share capital of 172 800 euros and registered office at 30 rue Rabelais 57200 Sarreguemines FRANCE, registration no. B 307 349 985 in the register of companies in Sarreguemines and, any purchaser, natural or legal person wishing to make a purchase on SDAA’s website www.sdaa-france.com, hereinafter referred to as “purchaser”.

These conditions apply to the exclusion of all other conditions.

Subject

These conditions aim to define the terms of sale between “SDAA” and the purchaser as well as the conditions applicable to any purchase completed through SDAA’s trading site, whether the purchaser is professional or consumer. The acquisition of a good through this website involves a full acceptance by the purchaser of these general conditions of sale.

These conditions of sale shall prevail over all other general or particular terms that have not been expressly agreed upon by “SDAA”, which reserves the right to modify these terms of sale at any time. In this case, the applicable conditions will be the ones in effect at the date of the order by the purchaser.

Products, prices and quantities

The purchaser will compose his product according to the options offered by the configurator appearing on the SDAA site. Because fragrances could slightly color the shape of the freshener, SDAA design team will validate the choice of the perfume made by the purchaser. The photographs of the visuals are reproduced as faithfully as possible. The press proof validated by the Purchaser will prevail and initiate production. Small shifts can be observed in the shape of the support during the cutting operation. These offsets are acceptable up to +/- 1mm. The scented support must be withdrawn gradually from the sachet and not entirely. The approximate release time of the fragrance is up to 14 days, depending on conditions of use such as temperature or humidity.

Minimum quantity of order is 100 pieces per model. Price per:

• 100 pieces: 2.28 € without taxes / unit - Total amount taxes inclued:  274 € (2.74 € /unit)
• 200 pieces: 1.82 € without taxes / unit - Total amount taxes inclued: 438 € (2.19 € /unit)
• 300 pieces: 1.33 € without taxes / unit - Total amount taxes inclued: 480 € (1.60 € /unit)
• 400 pieces: 1.21 € without taxes / unit - Total amount taxes inclued: 580 € (1.45 € /unit)
• 500 pieces: 0.99 € without taxes / unit - Total amount taxes inclued: 595 € (1.19 € /unit)
• More than 500 pieces: please contact us.

Prices shall be expressed in Euro and include the VAT applicable on the day of the order. Any change in the applicable VAT rate may be passed on in the selling price of the items. The indicated prices include the costs of order processing. Shipping charges are at the cost of the purchaser.

The products are individually packaged in a cellophane envelope. A “gift wrapping” option is available at a price of € 2 including tax for 100 units.
A second option of a 40 x 25 mm "sticker" is also available at the unit price of € 0.06 including tax. This label allows to personalize your gift with the text of your choice.

SDAA reserves the right to alter its prices at any time, being however understood that the prices that appear in the configurator in the daytime of the order will be the only one applicable to the purchaser.

An invoice will be sent at latest the day of delivery.

Delivery zone

The sale of air freshener's customize service is reserved to purchasers residing in metropolitan France and the overseas departments, in world zone 1 to 3 (please see section “shipping costs” below) and to shipments required in these geographical areas. Any purchaser from outside these zones can contact us by email, telephone, fax, or mail.

Order process on www.sdaa-france.com

A purchaser who wants to place an order on www.sdaa-france.com must:

• provide all necessary information for delivery by completing the electronic  identification form with requested data
• fill out the online order form and indicate all the references of chosen products
• verify and confirm your order
• make the payment under the terms provided
• confirm the order and payment

Order confirmation

The design office will provide technical advice on the choices to be made (fragrance, format or picture). The purchaser is invited to check the soft proofing proposed. If it meets his expectations, the purchaser signs and dates this proof by affixing the words "Good to be printed".
This validation gives acceptance of these conditions of sale, the recognition of having full knowledge of them and the waiver of its own conditions of purchase or other conditions.

Receipt by SDAA of the proof validated by the Purchaser leads to the production of the order. All provided datas and the recorded confirmation will constitute proof of the transaction. SDAA will send confirmation of the order recorded by email.

Availability

The products and prices are valid as long as the custom configuration service is visible on the website www.sdaa-france.com.

Shipping costs

The amount of shipping fees is based on the volume and the total weight of the products ordered as well as the country of delivery.
The delivery time is 4 weeks. This period starts from the validation of the soft proofing by the purchaser.

Delivery is made to the address indicated by the purchaser on the order form. This address must allow accessible delivery and a person present to receive the package. If not applicable, the package will be returned to SDAA. Any new shipment will be subject to shipping costs payable by the purchaser, by Paypal, CB or bank transfer. The purchaser will reside in metropolitan France, in the overseas departments and zones 1 to 3 as below:

Overseas departements 1: Guadeloupe, Martinique, Guyanne, La Réunion, St Pierre et Miquelon, Mayotte 
Overseas departements 2: Nouvelle Calédonie, Polynésie Française, Terres Australes et Antarctiques, Wallis et Futuna

Zone 1: Andorre, Monaco, Belgique, Pays-Bas, Luxembourg, Allemagne, Autriche, Italie, Royaume-Uni, San Marin*, Liechtenstein*, Suisse*, Danemark, Espagne, Portugal, Irlande, République Tchèque, Hongrie, Pologne, Slovénie, Slovaquie, Suède, Finlande, Bulgarie, Roumanie, Estonie, Lettonie, Lituanie, Grèce, Malte, Chypre*

Zone 2 : Norvège *, Maroc* , Tunisie* , Algérie *
Zone 3 : Other countries * 

* Customs formalities need to be followed for these countries

Any purchaser living outside of these areas can contact the company directly by email or phone.

Deliveries are made by La Poste or another carrier. The risks are the responsibility of the purchaser as soon the goods are leaving SDAA company.

The average delivery time is 48 hours. Deliveries made in Corsica, Overseas and Areas 1 to 3 above may require longer delivery times due to the islands specificities. These delivery times are indicative. If they are longer than thirty days (from dispatch), the sales contract is broken and the purchaser reimbursed. In the event of a shipment delay, SDAA informs the purchaser who can cancel the order. 

In the case of late delivery and if the product has been shipped, the purchaser must refuse delivery. He will be reimbursed according to the terms of return.

During delivery, after checking the package and its contents, the purchaser agrees to sign the delivery receipt presented by the carrier. In the event of an anomaly noted on delivery, the Purchaser must withdraw the reservations from the departure slip, have the document signed by the carrier and keep a copy. Any damage during transport must be justified and formulated with the carrier within three days of delivery. By signing the delivery receipt without making comments, the purchaser acknowledges having received the products in satisfactory condition.

Paiement

50% deposit will be paid at ordering, by PayPal, credit card or bank transfer.
The payment of the balance of 50% will be done in the same way, after validation of the soft proofing to allow start of production.

SDAA reserves the right to cancel the order in the event of non-payment or partial payment. 

Withdrawal

If the product does not comply with the soft proofing, the purchaser has fourteen days (from receipt of his order) to withdraw without penalty and return his order to: SDAA - Customer Service | 30 rue Rabelais - 57200 Sarreguemines or by email to: contact@sdaa-france.com

Return / shipping costs are the responsibility of the purchaser.

Warranty

Consequences of improper use of the goods are not covered by the contractual guaranties. It is strongly recommended to read the instructions prior to use.
All products provided by SDAA are covered by the legal guarantee as stipulated in article 1641 and following of the French Civil Code. 

Limitation of Liability

SDAA, in the online sales process, is bound by an obligation of means.

Its liability shall not cover any damage caused by the use of the Internet network such as loss of data, intrusion, virus, breakdown in the service, or any other involuntary problems such as strikes, social movements disrupting transport, confinement imposed by the authorities, ...

Intellectual Property Rights

All the material on SDAA’s website is and remains the exclusive intellectual property of SDAA. It is strictly forbidden to reproduce, exploit, re-use for any purpose whatsoever even as small excerpts any material from the website whether software, visual or audio. Any single link or hyperlink is strictly prohibited and requires SDAA’s formal written agreement authorization.

Photos, contents and any shared information

You hereby agree to release SDAA from all liability in the event of complaints of any kind relating to the use of your photos, content and any other information and used at SDAA's sole and absolute discretion. Also, you waive any prosecution.
By sending us your photos, content and other information, you declare and guarantee that these elements do not infringe any brand, do not infringe personality rights, are free of copyright and image rights , are not offensive and defamatory, are not contrary to the protection of children, do not incite violence, hatred or discrimination.
SDAA has the right to refuse to publish photos, content and any other information that deems to be abusive, derogatory or unethical.

Archiving & Proof 

SDAA stores order forms and invoices on a safe and durable media constituting an accurate copy as required by the article 1348 of the French Civil Code.
Electronic records stored by SDAA shall be considered by both parties as proof of communication, orders, payments and transactions between the two parties.

Governing Laws and Jurisdiction

These terms and conditions of sale shall be governed by French law. The parties submit to the exclusive jurisdiction of French courts.
